Rummage Terms of Service
Last updated: [DATE]
Draft. This document is being finalised and may change before Rummage launches.
These terms are an agreement between you and [LEGAL NAME], trading as Rummage ("we", "us"), of [BUSINESS ADDRESS]. They apply to the Rummage app and to rummage.kitchen (the "Service"). By creating an account or using the Service you agree to them. If you don't agree, please don't use Rummage.
Please also read our Privacy Policy, which explains how we use your data.
1. Who can use Rummage
You must be 16 or over. You must give us accurate information and keep your login details secure. You are responsible for what happens under your account.
2. What Rummage does
Rummage helps you decide what to cook from what you have: it can identify ingredients from photos, suggest and write recipes using AI, track your pantry and use-by dates, plan meals, build shopping lists, and guide you while you cook. Features may change or be added or removed over time.
3. AI-generated content — please read
Recipes, ingredient identification, nutrition figures, cooking times, photos of dishes and cooking feedback are produced by artificial intelligence and can be wrong. They are suggestions, not professional advice. Images of dishes are AI-generated illustrations and may not look exactly like the result you get. Use your own judgement and check anything important.
4. Allergies, diet and food safety — important
Rummage lets you tell us about allergies and dietary needs and uses them to avoid unsuitable recipes. This is a helpful filter, not a guarantee.
- AI can miss an ingredient, mislabel a dish, or misread a photo. Our filters can fail.
- You must always check ingredient lists and product labels yourself, especially if you or anyone you cook for has a food allergy or intolerance. If you have a serious allergy, do not rely on Rummage alone.
- Shelf-life and "use by" estimates are rough guides based on general information, not the date on the packet. The date printed on the product always takes priority. Do not eat food you believe is unsafe because the app suggested it was fine.
- Cooking times and temperatures are guidance. Follow safe food-handling practice, including cooking meat, poultry and eggs thoroughly as appropriate.
- Rummage is not medical or dietary advice.
Nothing in these terms limits any responsibility we cannot lawfully limit (see section 12).
5. Plans, subscriptions and payment
Plans. Rummage has a free plan ("Taster") and paid plans ("Cook" and "Chef"). The current prices, billing periods and what each plan includes are shown on the plan screen in the app before you buy. Where a plan has a monthly allowance of "AI actions", an AI action is one use of an AI-powered feature as described in the app.
Billing. Subscriptions are bought through Apple (or, on Android, Google) and are charged to your store account. We never receive your card details. Payment is taken at confirmation of purchase.
Automatic renewal. Subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. You can manage or cancel in your device's subscription settings (on iPhone: Settings → your name → Subscriptions). Deleting the app or your Rummage account does not cancel your subscription — you must cancel it in your store account.
Price changes. If we change a price we will give you notice as the store requires. You can cancel before it applies.
Refunds and your cancellation rights. Because purchases are made through the store, refunds are handled by Apple (or Google) under their policies, and you can request one from them. [SOLICITOR: confirm wording of the UK 14-day cancellation right for digital content and how it interacts with the store's process.] This does not affect your statutory rights.
Allowances and fair use. Plans include usage limits so the Service stays fair and affordable for everyone. Some features also have a fair-use ceiling that applies even on paid plans. We may refuse or limit use that goes beyond normal personal use. Your allowance renews on a rolling monthly cycle.
Free plan. We may change or end the free plan, giving reasonable notice.
6. Your content
You own your content — your photos, notes, recipes you write, ratings and the other material you add ("Your Content"). You grant us a limited, non-exclusive, worldwide licence to host, process, copy and display Your Content, and to send it to the service providers that help us run Rummage, only so that we can provide and improve the Service to you. We do not publish Your Content or make it available to other users. [UPDATE if sharing features are added.]
You promise that you have the right to use and upload Your Content and that it doesn't break the law or anyone's rights.
7. Importing recipes from other sources
Rummage lets you import recipes from web links, social media posts and photographs of printed recipes for your own personal use. Recipe text and photos often belong to their authors or publishers.
- You are responsible for making sure your use is allowed. Only import material you have the right to use, and don't republish or distribute it.
- Imported recipes are stored privately in your account and show their source where we know it.
- Rummage is not affiliated with, endorsed by or sponsored by any website, publisher or social platform (including TikTok and Instagram), and uses their names only to say what you can import from.
If you believe something in Rummage infringes your rights, see our Copyright Policy.
8. Acceptable use
You agree not to:
- use Rummage unlawfully or to harm, harass or deceive anyone;
- upload illegal content, or content that infringes others' rights;
- try to break, probe, overload or bypass the security or limits of the Service;
- use automated means (bots, scrapers) to access it or to avoid usage limits;
- reverse-engineer the app, except where the law allows;
- resell or commercially exploit the Service or its AI outputs at scale;
- use the Service to build a competing product by copying it.
We may suspend or end accounts that break these rules.
9. Our intellectual property
Rummage — its software, design, branding, text and the features we create — belongs to us or our licensors and is protected by law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial use, subject to these terms.
AI outputs. As between you and us, you may use the recipes and other outputs the Service generates for you for your own personal use. Because AI output may resemble output generated for others, we cannot promise it is unique or free of third-party rights.
10. Third-party services
The Service depends on third parties (such as Apple and Google, AI providers, and hosting providers). We are not responsible for their services or for interruptions to them. Your use of Apple's or Google's store is governed by their terms.
11. Availability and changes
We aim to keep Rummage running but cannot promise it will always be available or error-free. We may update, suspend or discontinue features. If we discontinue a paid feature you have paid for, we will give you a fair remedy (for example a refund for the unused period) where the law requires.
12. Our responsibility to you
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law doesn't allow us to exclude or limit — including your statutory rights as a consumer.
Subject to that:
- We provide the Service with reasonable care and skill, but, because it relies on AI, we cannot guarantee that any recipe, identification, estimate or allergen check is accurate, complete or suitable for you.
- We are not liable for loss you could not reasonably have foreseen, for business or commercial loss (the Service is for personal use), or for loss caused by you relying on AI output without making the checks described in section 4.
- Our total liability to you for any one claim is limited to the greater of the amount you paid us in the 12 months before the claim and £100. [SOLICITOR: review whether this cap is reasonable under the Consumer Rights Act and UCTA.]
13. Ending your relationship with us
You can stop using Rummage and delete your account in the app (Profile → Account). Remember to cancel any subscription separately (section 5). We may suspend or close your account if you seriously or repeatedly break these terms, or if we have to by law, and we will tell you why where we can.
14. Changes to these terms
We may update these terms, for example to reflect new features or changes in the law. If a change materially affects you we will tell you in the app or by email in advance. If you keep using Rummage after the change takes effect, you accept the new terms.
15. Apple-specific terms
If you use Rummage on an Apple device:
- These terms are between you and us, not Apple. Apple is not responsible for the app or its content, maintenance or support, and has no warranty obligations beyond refunding the purchase price of the app if it fails to conform to any applicable warranty.
- Apple is not responsible for addressing claims about the app, including product liability, legal compliance, consumer-protection or intellectual-property claims.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
- You confirm you are not in a country subject to a US embargo or listed as a restricted party.
- Apple's standard Licensed Application End User Licence Agreement also applies. If it conflicts with these terms on a point it covers, Apple's terms prevail on that point.
16. Law, disputes and contact
These terms are governed by the law of England and Wales. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts of your home country. Disputes are for the courts of England and Wales, unless that is inconsistent with your rights as a consumer.
We would always rather resolve a problem informally first: support@rummage.kitchen.
